Civil and Small Claims Matters

The Court has jurisdiction in Civil and Small Claim Cases up to a value of $3,000.00.

Civil Matters / Justice Court
You or the party you wish to sue must reside or have a primary place of business in the Village of Elmsford. If you reside in the Village of Elmsford, you may sue anyone residing or that has a business in Westchester County. The filing fee for this is $20.00 and the Summons must be served. Small Claims Actions
The party you wish to sue must reside or have their place of business in the Village of Elmsford. The fee for filing small claims is based on the amount for which you are suing. For amounts up to $1,000.00, the filing fee is $10.00; for amounts greater than $1,000.00 up to and including $3,000.00, the filing fee is $15.00. Service is by First Class and Certified Mail. Criminal Matters

The Village of Elmsford Court hears all criminal cases when the crime has been committed in the Village of Elmsford.

These matters are prosecuted by the Westchester County District Attorney’s Office. The jurisdiction for sentencing in a local court is where the maximum sentence is up to one year in jail and the fine up to $1,000.00.

 

Landlord-Tenant Matters

The property must be in the Village of Elmsford

Filing fee is $20.00 after remitting summons with Affidavit of Service

Most, if not all, Summary Proceedings (Notice of Eviction) are handled by an Attorney retained by the Landlord

Please note that Court Clerk Staff are not attorneys and thus cannot provide any legal advice. As such, the Court cannot provide guidance to Landlords seeking to evict Tenants. Additionally, the Court cannot dispense advice to Tenants who have been served with a Notice of Eviction.
